Ploom Club Terms and Conditions | Ploom Philippines

I. ELIGIBILITY; GENERAL TERMS AND CONDITIONS

1.   PLOOM CLUB is a Loyalty/Rewards Program open to adult PLOOM (products) users 18 years old and above (as of the date of his/her participation in the Program) and residing in the Philippines, are successfully registered, verified, and activated by JT International Inc., Philippines (JTIP) on the https://ploom.ph (website).  

2.   Through PLOOM CLUB, registered members can enjoy the program's exclusive benefits or rewards, such as e-vouchers, unique experiences, and special offers, by collecting Ploom Club Points through participation in certain tasks or activities.

3.   All PLOOM CLUB-related programs are only currently available within the National Capital Region (NCR) in the Philippines via https://ploom.ph (website), and is subject to the applicable local government regulations, national law and other applicable government regulations issued from time to time.

4.   Employees of JTIP, its affiliates, distributors, third-party vendors, and service providers (referred to collectively as Organizers of the Program), their relatives up to 4th degree of consanguinity or affinity are disqualified from joining.

5.   To be member of PLOOM CLUB, consumers must sign up for a Ploom Account and get verified on https://ploom.ph (registration page: How to register for a Ploom Account?).

        a.  Registration may take place at any time provided you are an adult         user aged 18 years old and above of one of the above-mentioned         Device models. In completing the registration process, you must         provide all required mandatory information in an accurate and         complete manner and keep this information up-to-date. If you do              not complete the mandatory fields in the application form (such as,         for example, age, smoker status, email address and/or phone         number) your application will not proceed. If you provide inaccurate         or incomplete information JTIP reserves the right to terminate your         membership of PLOOM CLUB without notice.

        b.  Following the registration process for a https://ploom.ph account,         you will be informed whether your registration is successful.         Membership of PLOOM CLUB and Benefits it provides are personal         to you and may not be transferred to any third party.

        c.  Your local PLOOM CLUB membership is only available in your              country of residence. Terms & Conditions stated here is applicable            to the Philippines only.

6.   By joining and participating in the Program, those qualified and interested to join the Program (Program Participants) hereby confirm, agree, and acknowledge that:

        a.  Program Participants have read the full mechanics of this Program         and agree to abide by the terms and conditions of the same;

        b.   JTIP is permitted to receive the Program Participants’         registration data and all personal information supplied by the         Program Participant will be used by JTIP in accordance with its         privacy policy, for the purpose of running the Program, and other         marketing activities;

        c.  Organizers of the Program have the right to identify Program         Participant as a participant or a winner in the Program and         communicate the same at any time, in any territory in the Philippines         and through any medium of release (including digital and social         media platforms, where allowed by applicable law);

        d.  Program Participants shall hold Organizers of the Program free         and harmless from any and all claims, suits and actions for damages         or liabilities that may be brought by them, or other persons, natural         or juridical, in connection with their participation in this Program as         well as the statements and declarations made by participant in         relation to the Program;

        e.  Organizers of the Program may, without further compensation to         Program Participant: (a) reproduce, distribute, adapt, modify, make         available, and/or communicate to the public, exhibit, or broadcast         any material or information supplied by such Program Participant         regarding this Program, by any means or media without restriction of         any kind as to quantity, purpose or time, whether commercial or         otherwise, or to any territory in the Philippines (including those using         digital and social media platforms, where allowed by applicable law);         and (b) authorize any of the above activities; and  

        f.  Organizers of the Program shall not be liable for any unauthorized         use, reproduction, and/or adaptations by third parties of any material         or information regarding this Program.

        g.  The Program will be available starting October 28, 2024.  JTIP         reserves the right to change and/or withdraw the Program as         business exigencies require. 

        h.  Joining the Program is not mandatory. Registered and verified         Ploom Club members may choose not to participate in the Program.

        i.  JTIP reserves the right to modify or change the mechanics of the         Program.  Any such change shall be communicated via email directly         to each member’s registered email address or through other suitable         means at ’s sole and reasonable discretion.

        j.  Program Participants who use multiple registration accounts shall         automatically be disqualified.  JTIP reserves the right to validate the         registered/verified Ploom Club member’s eligibility status at any         time, and to suspend, block, and/or ban a participant’s account         should there be a well-founded belief, as shown by evidence, that         there are irregularities in, and/or has been a fraudulent use and/or         abuse of the participant’s account by any means including those         done through deceit or similar machinations.

        k.  JTIP reserves the right to amend or cancel the Program without         notice should there be any event of cheating, fraud, security or data         breach (or threatened breach), violation of applicable laws or         regulations, or an event considered as force majeure (such as, but         not limited to, acts of God, technical issues, pandemic, civil unrest,         coup d’etat or military takeover, and/or any events which are beyond         the reasonable control of JTIP).  Any change in the Program shall be         communicated to the Ploom Club member as soon as reasonably         possible.

        l.  If you do not agree (or cannot comply) with these Terms, then you         are not permitted to participate in PLOOM CLUB.

7.   This Program is being carried out by Japan Tobacco Inc., Philippines (or “JTIP”).

8.   Your use of PLOOM CLUB is at our discretion, and we may refuse your application for any reason we see fit. We may also terminate your right to use PLOOM CLUB for any reason if you breach any of these Terms and Conditions.

9.   You are only eligible for membership of PLOOM CLUB if: (i) you are a Ploom user aged 18 years old and above (as of the date of your participation in the Program) residing in the Philippines who otherwise wish to continue to use tobacco or nicotine containing products; and (ii) you are registered in our PLOOM CLUB database.

10.   PLOOM CLUB membership is only open to living persons. Companies, partnerships, unincorporated associations, and other legal entities are not eligible for membership.

11.   A member of PLOOM CLUB may not have multiple memberships and must maintain only one account in the PLOOM website. Customers using multiple Ploom.ph accounts to participate in the Program will be disqualified. JTIP reserves the right to disqualify any Customer if there is any evidence of fraud or irregularities in his/her participation in the Program.

II. PLOOM CLUB DIGITAL MEMBERSHIP CARD

1.   Once ploom.ph account has been verified and activated, the Ploom Club Member will receive a Ploom Club digital membership card via his registered email account within 5-7 days.

2.   The digital membership card will serve as an identification to verify your Ploom Club membership and may be used exclusively for future Ploom Club premium brand offers.

3.   The digital membership card is not a discount card and does not have any monetary value.

4.   Member shall receive a new digital membership card once he/she has moved to a higher membership tier/level. See Section V. Ploom Club Membership Tiers in Terms & Conditions.

III. HOW TO EARN POINTS?

1.   Once registered in https://ploom.ph (website), verified user can participate in any of the task-earning activities of PLOOM CLUB.

2.   Each action/activity will have corresponding PLOOM CLUB Points to be earned once completed.

3.   PLOOM CLUB Points will reflect on the member’s Ploom Club Account Dashboard.

4.   Every accomplished task and earned PLOOM CLUB Points will show in your PLOOM CLUB transaction history.

6.   Your earned PLOOM CLUB Points will allow you to redeem various Rewards and Benefits. The choice of Rewards is subject to availability.

IV. REWARDS AND BENEFITS

1.   Being a PLOOM CLUB Member entitles you to enjoy various Rewards and Benefits (subject to availability), through the collection and exchanging of PLOOM CLUB Points and reaching different Membership Tiers/Levels.

2.   Current Rewards and Benefits:

        a.  Exchange PLOOM CLUB Points to Ploom Shop Credits
 

        b.  PLOOM CLUB Points are applicable for exchange, limited to the         corresponding Ploom Shop Credits identified on the above table         and may be redeemed exclusively to products bought from the         online Ploom Shop upon checkout

        c.  Value of Ploom Shop Credits are all the same and applies across         membership tiers.

        d.  Ploom Shop Credits may only be used once per transaction.

        e.  Ploom Shop Credits are not stackable nor transferrable to any         third party or other PLOOM CLUB accounts.

4.    JTIP reserves the right to modify the Rewards and Benefits mechanics at its discretion, with prior notice. 

V. PLOOM CLUB MEMBERSHIP TIERS (LEVELS)

1.   PLOOM CLUB has (3) three Membership Tiers: Silver, Gold and Black (Membership Tier). Your Membership Tier determines the Rewards and Benefits that you are entitles to as a member of PLOOM CLUB.

2.   Upon joining PLOOM CLUB, you’ll be automatically tagged as a Silver member for your initial Membership Tier.

3.   The number of Ploom Club Points you earn in each Membership Tier determines your eligibility for the next Membership Term.

4.   The required number of Ploom Club Points for each Membership Tier is detailed here [ https://www.ploom.ph/en/club#/]. JTIP reserves the right to modify the required number of Status Points for any Status Level at its discretion, with prior notice.

 VI. REFER-A-FRIEND PROGRAM

1.   Definition of Terms

        a.  Referrer – a PLOOM CLUB member who is an existing adult         smoker or nicotine product user at least 18 years old or older,         residing in the Philippines, and registered via https://ploom.ph.

        b.  Referral Code – a valid unique code provided to each Referrer         that is accessible in ploom.ph on which the Referrer could share to         participate in the Program.

        c.  Referee – an adult smoker or nicotine product user who is at         least 18 years old or older and residing in the Philippines who         otherwise wish to continue to use tobacco products or nicotine-        containing products and should not have a pre-existing PLOOM.ph         account yet nor is a PLOOM device user prior to this Program, and         decides under this Program to purchase their first PLOOM         device/product in the Philippines using the referral code shared by         the Referrer.

2.   Eligibility/Who Can Participate

        a.  The Referral is open to all Referees with access to a referral code         shared to them by a Referrer.

        b.  The Referrer can participate in the Program by sharing his/her         unique referral code to a Referee.

        c.  The Referee can participate in the Program by using the referral         code to purchase his/her first PLOOM tasting / device kit or other         PLOOM products (Mevius for Ploom Sticks and or Accessories),         exclusively from PLOOM.ph online store.

        d.  The Refer-A-Friend Program is valid only for PLOOM.ph         transactions. The unique referral code will not be accepted in retail         pop-up stores/kiosks or in any retail PLOOM partner merchants.

3.   Specific Terms of the Offer

        a.  The Referrer will share his/her unique referral code to the         Referee, and the Referee will enjoy a discount when purchasing         his/her first PLOOM tasting/device kit and or other PLOOM         products (Mevius for Ploom Sticks and Accessories).

        b.  The Referrer will receive 150 PLOOM CLUB points for every         successful first PLOOM purchase by a unique Referee using the         Referrer’s referral code. “Unique Referee” means a Referee who is a         one-time referral of the Referrer.

        c.  The Referee must input the Referrer’s referral code in the promo         section of the check-out page in https://ploom.ph for validation         before it can be used to purchase any PLOOM products.

        d.  A Referee can only use one valid referral code to be used solely         for purchase on the website, https://ploom.ph.

        e.  The Referree will be subject to age verification process wherein         he/she will be requested to submit a valid Government Issued ID.         The following valid Government Issued IDs as proof of age:         Passport, Alien Certificate of Registration, Driver’s License, Firearms         License, NBI Clearance Card, Philhealth ID, Postal ID, PRC ID, SSS         ID, TIN ID, Unified Multi-Purpose ID or Voter’s ID.
